Er entstand 1941/42, als er beim Stab des Militärbefehlhabers im besetzten Frankreich, Otto von Stülpnagel, seinen Dienst in Paris versah (siehe Jüngers "Strahlungen"). Im Herbst 1941 häuften sich Attentate auf deutsche Militärangehörige. Die Repression der deutschen Besatzer in Form von Geiselerschiessungen eskalierte: von Berlin angeordnet, gegen die Überzeugung Stülpnagels, der vermutlich angeregt durch Hans Speidel, einem der späteren Mitverschwörer des 20. Juli, die Anfertigung dieser Denkschrift veranlasste. Ein Dokument aus einer dunklen Zeit, kein literarischer Text, eine eher sachlich-polizeiliche, ja fast kriminologische Abhandlung über Gewalt und Gegengewalt, die durch die von Jünger bereits dem Original beigegebenen Übersetzungen der Abschiedsbriefe der Exekutierten (Stoffquelle für einen gerade entstehenden Film) eine überzeitliche Bedeutung erhält.
