|a Les concepts de sacra potestas et de « séparation des pouvoirs » tels qu’il sont induits dans la recommandation 34 de la CIASE peuvent paraître radicalement hétérogènes, voire en opposition. Le premier relèverait alors d’une approche théologique alors que le second serait strictement mondain. Cet article vise à dépasser cet antagonisme en montrant que la portée théologique des catégories utilisées pour qualifier le fondement de l’institution ecclésiale ne peut être comprises qu’à partir de leur enracinement historique et en lien avec les compréhensions politiques séculières du pouvoir qui elles-mêmes peuvent porter des aspirations à une forme de transcendance. C’est à cette condition que les perspectives du droit canonique à propos d’un exercice décentré et synodal du pouvoir pourront être envisagées.

|a The concepts of sacra potestas and « separation of powers » as implied in recommendation 34 of the CIASE may seem radically heterogeneous, even in opposition. The former would then fall under a theological approach, while the latter would be strictly worldly. This article aims to overcome this antagonism by demonstrating that the theological significance of the categories used to qualify the foundation of the ecclesial institution can only be understood based on their historical roots and in connection with secular political understandings of power, which themselves may carry aspirations to a form of transcendence. It is under these conditions that perspectives of canon law regarding a decentralized and synodal exercise of power can be considered.
