|a Pape de 1740 à 1758, Benoît XIV (Prospero Lambertini) est largement reconnu comme l’un des plus grands canonistes de l’ère post-tridentine. Il a accompli des efforts considérables pour adapter le droit canonique latin aux exigences de l’efficacité normative moderne, et ce plus d’un siècle avant la codification de 1917. À cet égard, son œuvre mérite toujours une attention spéciale. Qu’en est-il de son approche du droit canonique des Églises catholiques de rite oriental, en ce qui concerne les diverses étapes de sa modernisation ? À partir d’une perspective historique, cette étude entend montrer que ce pape canoniste a contribué activement au processus de rationalisation normative, toujours guidé par une attention particulière à la relation entre législation générale et législations particulières. Avec Benoît XIV, le droit canonique a franchi une étape. Il demeure une source d’inspiration pour les canonistes, ardemment invités à recourir à des principes méthodologiques fondés sur de solides recherches historiques. Contre toutes les formes de positivisme et de légalisme abstrait, cette méthodologie correspond à la nature intrinsèque du droit canonique.

|a Pope from 1940 to 1958, Benedict XIV (Prospero Lambertini) is widely recognized as one of the greatest canonists of the post-tridentine area. He made considerable efforts to adapt Latin canon law to the requirements of modern normative efficiency, more than one century before the 1917 codification. In this respect, his work still deserve a special attention. What about his approach of Eastern Catholic canon law, concerning the various steps of its modernization ? From a historical perspective, this study intends to show that this canonist pope actively contributed to the process of normative rationalization, always guided by a particular attention to the relationship between general and particular legislations. With Benedict XIV, canon law has taken a major step forward. He still remains an inspiring source for canonists urged to use methodological principles based on strong historical researches. Against all forms of positivism and abstract legalism, this methodology corresponds to the intrinsic nature of canon law.
