Das Werk ist in drei Kapitel unterteilt, die nacheinander der Entstehung, Überwindung und Widerlegung der Positivismuslegende gewidmet sind, sowie in einen Epilog, der versucht, die enge Verbindung zwischen Rechtspositivismus und liberaler Demokratie aufzuzeigen. Darüber hinaus enthält das Buch auch eine Originalstudie über die Einfuhr der Legende des Positivismus in Brasilien. / »An Unfair Verdict: Dismantling Legal Positivism’s Responsibility for Nazism«: This book provides an in-depth historical analysis of what the German legal culture refers to as the »Positivism's Myth«, a term which denotes a misleading perception of its recent history that blames Legal Positivism in general and Hans Kelsen's Pure Legalism in particular as the legal theoretical framework responsible for the decline of democratic institutions during the Weimar Republic period and for the legitimacy of the Nazi dictatorship.
