|a German Abstract: Die Geschichte des kommunalen Planungsrechts ist ein komplexes und rechtshistorisch anspruchsvolles Forschungsfeld, welches bisher nur in Ansätzen untersucht wurde. Zum Verständnis der rechtlichen und sozialen Zusammenhänge erscheint es nötig, Planung nicht nur in einem engen Sinne – als städtische Bauleitplanung – zu verstehen, sondern auch die Planung kommunaler Infrastrukturen einzubeziehen. Der vorliegende Beitrag untersucht die Entwicklung der rechtlichen Rahmenbedingungen nicht nur für die städtische Bauleitplanung, sondern auch für die Planung technischer Infrastrukturen (Gas, Kanalisation, Wasserversorgung und Elektrizität) in den deutschen Einzelstaaten Preußen und Baden. Dabei zeigt sich, dass das Maß an kommunaler Gestaltungsfreiheit nur erkennbar wird, wenn man sich im Detail mit dem damaligen Verständnis von „Polizei“ auseinandersetzt und auf das Zusammenspiel verschiedener Kompetenzen schaut

|a English Abstract: The history of urban planning law is a complex and legal-historically demanding field of research, which to date has only been studied in a rudimentary fashion. In order to understand the legal and social context, it seems necessary to understand planning not only in a narrow sense – as urban land-use planning – but also to include the planning of municipal infrastructures. The present contribution therefore examines the development of the legal framework not only for urban land-use planning but also for the planning of technical infrastructures (gas, sewerage, water supply and electricity) in the German states of Prussia and Baden. It becomes apparent that the degree of municipal freedom of action can only be discerned if one considers in detail how ‘Polizei’ was understood at that time and looks at the interaction of different competences
