Der Rechtshistoriker Benjamin Lahusen deckt in seiner Studie unheimliche Kontinuitäten der deutschen Justiz auf und zeichnet so das eindringliche Bild einer Gesellschaft, die den großen Einschnitt so klein wie möglich hielt. -- Stuttgart, im September 1944: Das Justizgebäude wird durch neun Sprengbomben und zahlreiche Brandbomben weitgehend zerstört, doch stolz meldet der Generalstaatsanwalt, dass bereits am nächsten Morgen "noch in den Rauchschwaden... eine Reihe von Strafverhandlungen durchgeführt" wurden. Auch andernorts wird der Dienstbetrieb in teils noch brennenden Gebäuden aufrechterhalten, später selbst unter Artilleriebeschuss. Benjamin Lahusen hat sich die Akten zahlreicher Gerichte - darunter des Amtsgerichts Auschwitz - aus den Jahren vor und nach 1945 angesehen und beschreibt höchst anschaulich, wie weder "Endkampf" noch staatlicher Zusammenbruch den juristischen Dienstbetrieb unterbrechen konnten. Er erklärt, warum ein Stillstand der Rechtspflege unter allen Umständen vermieden werden sollte, und zeigt, wie nach dem Krieg altgediente Juristen pflichtbewusst das alltägliche Recht des Dritten Reichs so weiterführten, als wäre nichts passiert. Wenn es noch eines Beweises dafür bedarf, dass es 1945 keine "Stunde Null" gab, dann liegt er mit diesem Buch vor
